TopTen™ Program Privacy Statement
This privacy statement explains data collection and use practices
of the Winter Corp. TopTen™ Survey Program (the “Program”) hosted by Winter
Corp. It does not apply to other online or offline Winter Corp. programs,
products or services. By accessing the Program, you are consenting to the
information collection and use practices described in this privacy statement.
Collecting Your Personal Information
We will collect personal information if you choose to access a Winter Corp.
survey. The personal information we collect includes your name, title, company
or organization name, work e-mail, work phone, work or home address, job title
and information about your database and database environment.
When you begin filling out the Program survey, certain anonymous information about your visit is automatically captured. This information includes the name of the Internet Protocol (IP) address through which you access the Internet; the date and time you access a survey and your browser type. None of this information is personally-identifiable. This anonymous information is used to help administer the Program, and is not used after administration of the program is complete.
Use and Disclosure of your Personal Information
The
personal information Winter Corp. collects when you begin filling out a survey
will be used to enter you in the TopTen Program. The personal information you
provide when you begin filling out a survey may be used to contact you, if
necessary by phone or email, to correct or complete your survey.
If you participate in the program your organization name and the figures you give for data size, workload and operating environment may be published in the winners' tables for the Program, unless you request anonymity. If you request anonymity, we will not publish your organization name, but instead will identify it as "Anonymous". If the number one winner in a category requests anonymity, the second place winner will be declared the Grand Prize Winner. Except for the foregoing details, no identifying information you submit in the survey will be disclosed, although we may disclose aggregated information obtained from the survey. Except for the limited use set out in the paragraph below, Winter Corp. does not allow any third parties to use participant information for a mailing list or marketing purposes.
Vendors of the hardware and software products tracked by the Program may want to contact their customers to encourage them to participate. To facilitate this, if you disclose in your survey response that you are a user of a particular hardware or software product, Winter Corp. may disclose your personal information to the vendor of that product and notify the vendor you are a participant in the current or a previous Program.
Winter Corp. occasionally hires other companies to provide limited services on our behalf, such as packaging, mailing and delivering prizes, answering customer questions about products and services, sending postal mail, and sending information about our products, special offers, and other new services. We will only provide those companies the personal information they need to deliver the service.
Winter Corp. may disclose personal information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served to Winter Corp. or the Program; (b) protect and defend the rights or property of Winter Corp. and our family of Web programs; or (c) act in urgent circumstances to protect the personal safety of users of Winter Corp., our Web programs, or the public.
Control of your Personal Information
Except as otherwise described in this statement, personal information you
provide to this Program will not be shared outside of Winter Corp. and its
controlled subsidiaries and affiliates without your permission. It will only be
used for the purposes stated above.
In
addition, we may use your personal information to contact you to market other
Winter Corporation products and services.
Please be aware that this Privacy Statement and any choices you make about the Program will not necessarily apply to personal information you may have provided to Winter Corp. in the context of other, separately operated, Winter Corp. products or services.
Access to your Personal Information
Customer information is collected by Information Technology Systems, a Winter
Corp. vendor. It is stored at Information Technology Systems, plus sent back to
Winter Corp. This information may be accessed or changed by accessing your
survey using your personal information
Cookies
We use session
cookies in the Program to help manage data collection. The session cookie
expires shortly after you complete the survey and is not placed on your hard
drive.
Changes to This Privacy Statement
We may occasionally update this privacy statement. When we do, we will also
revise the "last updated" date at the bottom of the privacy statement. For
material changes to this privacy statement, we will notify you either by
placing a prominent notice on the home page of our web site or by directly
sending you a notification. We encourage you to periodically review this
privacy statement to stay informed about how we are helping to protect the
personal information we collect. Your continued use of the service constitutes
your agreement to this privacy statement and any updates.
